NAB to FCC: Need "Holistic" Approach to Spectrum Plans
NAB, along with the Association for Maximum Service Television (MSTV), submitted comments to the Federal Communications Commission (FCC) on March 18 in response to the FCC's Notice of Proposed Rulemaking that concerns a variety of potential rule changes that could lay the "groundwork" for an auction of broadcast TV spectrum. NAB and MSTV told the FCC that it should consider the rulemaking - including rules that would allow two or more stations to share one channel and potential improvements to VHF - within a broader scope that examines the potential role of broadcasting as a companion to broadband in the future. NAB and MSTV also noted that several of the FCC's proposed changes are problematic from both engineering and public policy perspectives.

FCC License Renewal Cycle Starts June 1, 2011
Save the Date for NAB's License Renewal Webcast on April 26

The Federal Communications Commission (FCC) has released a Public Notice highlighting revisions to the license renewal application (Form 303-S), including new certifications concerning non-discriminatory advertising contracts and a station's minimum operating schedule. The new form also simplifies the RF Radiation certification.

FCC Reminds Broadcasters of Advertising Nondiscrimination Rule
In March 2008, the FCC released an Order adopting a requirement for broadcasters to certify on their license renewal applications that their advertising agreements contain nondiscrimination clauses. In March 2010, the FCC issued an Erratum clarifying that the requirement applies to discrimination based on race and ethnicity (not race and gender as the FCC stated in the original Order).

Ensure Your Radio Spots Comply with Federal Requirements
Some stations are currently airing spots to promote broadcast-radio enabled mobile phones. This is an issue that radio stations have advocated before Congress and the Administration, and as such, may be considered an "issue advocacy" spot.

Government Relations Update
As a follow up to State Leadership Conference, NAB is securing a member of Congress to lead a letter with other members on the benefits of radio-enabled mobile phones. This letter will be addressed to the Department of Homeland Security and FCC, and will be finalized in a couple of weeks, at which time we encourage all NAB members to circulate the letter to their congressional offices. Several meetings have been conducted recently with members of Congress on the benefits of radio-enabled mobile phones. For more information about this issue, click here.

NAB Television Financial Survey
The National Association of Broadcasters is conducting the annual 2011 Television Financial Survey. All eligible television stations that participate receive a complimentary copy of the final report, which will include approximately 80 tables of financial data.
