Pirate Radio Enforcement Legislation Introduced

On May 8, the PIRATE Act, which provides the Federal Communications Commission (FCC) with enhanced penalties and additional tools to take action against illegal pirate radio operations, was introduced in the House of Representatives. Pirate radio is a real threat to public health and safety, causes interference to legal radio broadcasts and flouts the rule of law.

Music Modernization Act Moves Forward in Senate

On April 26, the House passed the Music Modernization Act (MMA), H.R. 5447, by a unanimous 415-0 vote. This legislation is the byproduct of the multi-year copyright review shepherded by House Judiciary Chairman Bob Goodlatte (VA-06) and combined three previous standalone measures – the Music Modernization Act (H.R. 4706), which addresses issues relating to songwriter and publisher compensation by on-demand streaming services, the CLASSICS Act (H.R. 3301), which addresses royalties paid to owners of pre-1972 sound recordings, and the AMP Act (H.R. 881), which addresses royalties paid to music producers.

TV Frequency Moves Resources Available

NAB is providing tools and other resources to help you educate your communities about what TV station frequency moves will mean for those who rely on free, over-the-air TV. Time is Running Out to Register Your C-band Earth Station with the FCC

Last month, the Federal Communications Commission (FCC) established a docket on “Expanding Flexible Use of the 3.7 to 4.2 GHz Band.” Concurrently, the Commission also announced a 90-day filing window for existing C-band users (i.e., earth stations in operation as of April 19, 2018) that are not yet registered with the FCC to register their facilities. To encourage registration, the FCC is waiving the frequency coordination requirement but is not waiving the $435 filing fee during this 90-day window. The deadline for registration is July 18, 2018. After that date, you will likely not be able to protect your C-band facility from interference from wireless services, and you will not be eligible for funding to maintain service.

FCC Approves NPRM Addressing FM Translator Interference Rules

On May 10, the FCC approved of a Notice of Proposed Rulemaking (NPRM) proposing to streamline the rules relating to interference caused by FM translators. These new policies could extend local radio service through the use of translators while protecting the existing service of FM broadcasters. NAB looks forward to participating in the Commission’s proceeding.

Reminder: File TV Shared Services Agreements with the FCC

Late last year, the FCC reaffirmed its requirement for commercial TV stations to disclose their shared services agreements (SSAs) by placing them in their online public inspection files. This requirement took effect on March 23, 2018. Each commercial TV station that is a party to an SSA executed prior to that March 23 effective date is required to place a copy of the SSA in its public file within 180 days after March 23. SSAs executed after the effective date must be placed in stations’ online public files in a timely fashion. Stations will upload SSAs to a folder designated “Shared Service Agreements” on their station profile webpages. Further details about uploading SSAs can be found in the FCC’s public notice.
