National Report Launch NAB Radio Show to Feature FCC Commissioner Jonathan Adelstein
NAB announced today that Federal Communications Commission (FCC) Commissioner Jonathan Adelstein will speak during The NAB Radio Show®, held September 17-19 in Austin, Texas. A veteran of Washington, D.C., Commissioner Adelstein is expected to address a number of regulatory issues facing radio broadcasters, including the FCC's localism proceeding, HD Radio and low-power FM.

FCC Releases XM/Sirius Merger Order Detailing Conditions
The Federal Communications Commission (FCC) last week released the text of its Order approving the merger of Sirius Satellite Radio Inc. and XM Satellite Radio Holdings Inc. While the FCC concluded that the merger would violate its rule against one satellite radio licensee controlling both licenses and it found that, absent the voluntary commitments offered by Sirius and XM and other merger conditions designed to mitigate the harms, the merger would likely harm consumers and diversity, it refused to stop the merger from going forward.

New Coordinates for PSA Satellite Feed
NAB's monthly public service announcement satellite feed coordinates are changing. The new coordinates will be C-Band, Galaxy 25, Transponder C15, 97 degrees West, Downlink Frequency 4000 V, Audio: 6.2/6.8. The next feed will take place on Friday, August 15 from 11:30 a.m. - 12 p.m. (ET). Satellite Coordination Schedule Available

NAB Files Supreme Court Brief on Indecency
On Friday, August 8, NAB filed a "friend of the court" brief with the Supreme Court in the fleeting expletive indecency case. NAB's brief focused on the practical effects on broadcasters of the Federal Communications Commission's (FCC) recent arbitrary and inconsistent indecency decisions. The brief discussed the problems created by the FCC's unpredictable indecency enforcement policies, especially with regard to the airing of live programming including news. Given the Commission's failure to follow clear and consistent standards in applying its indecency policies, as required by the First Amendment, NAB explained that broadcasters have engaged in self-censorship of non-indecent content to try to protect themselves from FCC investigations and the potential imposition of fines or other penalties. Oral argument in this case - the first time the Supreme Court has addressed broadcast indecency regulation since 1978 - will be on November 4, 2008.

Correction: In the August 4 edition of The NAB Pulse, we reported that the 135 southeastern stations participating in the August 2, 2008, DTV roadblock aired a half-hour educational program following the 30-second PSA. While many of the stations did air a half-hour program, not all stations did.
