NAB Files Supreme Court Brief on Indecency
On Friday, August 8, NAB filed a "friend of the court" brief with the Supreme Court in the fleeting expletive indecency case. NAB's brief focused on the practical effects on broadcasters of the Federal Communications Commission's (FCC) recent arbitrary and inconsistent indecency decisions. The brief discussed the problems created by the FCC's unpredictable indecency enforcement policies, especially with regard to the airing of live programming including news. Given the Commission's failure to follow clear and consistent standards in applying its indecency policies, as required by the First Amendment, NAB explained that broadcasters have engaged in self-censorship of non-indecent content to try to protect themselves from FCC investigations and the potential imposition of fines or other penalties.
Oral argument in this case - the first time the Supreme Court has addressed broadcast indecency regulation since 1978 - will be on November 4, 2008.

Correction:
In the August 4 edition of The NAB Pulse, we reported that the 135 southeastern stations participating in the August 2, 2008, DTV roadblock aired a half-hour educational program following the 30-second PSA. While many of the stations did air a half-hour program, not all stations did.
