Performance Tax Opposition Three Votes Shy of House Majority
Thirteen senators and 215 House members are now on record in opposition to a record industry-backed effort to levy a "new performance fee, tax, royalty or other charge" on local radio stations for music airplay. In the last week, four new House members and two additional Senators joined the growing chorus in opposition to a campaign led by the Recording Industry Association of America.

New Poll Shows Near-Universal Awareness of DTV
The vast majority of the American public is aware of the upcoming transition to digital television (DTV), according to a new survey released by the National Association of Broadcasters. In a telephone survey of 31,426 television households, 90 percent of respondents reported being aware that broadcast television signals and programming will switch to a digital format on February 17, 2009, up from 83 percent found in an NAB-commissioned survey in January 2008.

Attention TV Broadcasters: New Database for Upcoming DTV Consumer Education Reports
This week the Federal Communications Commission (FCC) announced that the DTV Quarterly Activity Station Report (Form 388) must now be filed in the FCC's Consolidated Database System (CDBS). Previously, stations were required to file Form 388 via the FCC's electronic comment filing system. The next report is due on July 10.

NAB Supports Full “Carry One, Carry All” Carriage Rule in Comments
The National Association of Broadcasters reiterated its firm position in support of the proposed “carry one, carry all” requirement last week in a second round of comments concerning the ongoing clash between satellite providers and the Federal Communications Commission. Satellite television providers, such as DirecTV, protest the requirement, claiming they do not have the capacity to provide subscribers with programming in both HD and SD versions of local broadcast stations. NAB urged the FCC to investigate such claims of limited capacity before fully relying on them.
