NAB Members Pledge Continuation of TV Service Before and After DTV Transition
The National Association of Broadcasters announced on August 12 that television stations across the U.S. have embraced a pro-consumer initiative ensuring continued television service in the weeks leading up to and following the digital television (DTV) transition. The boards of directors of the ABC, CBS, FOX and NBC affiliate organizations have agreed to support a voluntary month-long 'quiet period' ensuring no disruption of local television service in the weeks leading up to and following the digital television transition.

NAB has launched a new online database that allows consumers to determine whether they receive programming from low-power television (LPTV) stations, which are not required to go exclusively digital next February.

Reminder: Political Window for General Election Fast Approaching
The lowest unit charge (LUC) window for the General Election will open Friday, September 5. Stations should have already calculated their LUC for each daypart and class of time sold at the station. These rates should be disclosed in the station's political folder in the public file. Additionally, the FCC has informally stated that stations that sell political spots on Election Day must sell at the LUC rate. If you have specific questions on political advertising, please call the NAB Legal department toll free at (866) 682-0276.

FCC Warns Fee Payers About Phishing
The FCC has opened the filing window for payment of fiscal year 2008 regulatory fees. Payments are due by 11:59 p.m. (eastern) on September 25, 2008. The FCC has also warned fee payers that non-government entities may be using Internet sites to misdirect fee payers. Some fee payers have complained that these entities are attempting to collect financial information. The FCC encourages parties to submit their fees directly through the FCC's official Web site: www.fcc.gov/feefiler. The FCC has also released updated procedures for submitting regulatory fees, or you may visit the FCC fee page for further information.

New Regulation Requiring High-Visibility Vests for Those Working On Federal-Aid Highway Right-Of-Ways
A regulation by the U.S. Department of Transportation’s Federal Highway Administration (FHWA) affecting broadcasters goes into effect on November 24, 2008. The regulation will require everyone working on federal-aid highways to wear high-visibility vests. FHWA has interpreted this regulation as including members of the media within the definition of "workers."

FCC Revises - But Does Not Reinstate - EEO Form 395-B
The FCC has amended FCC Form 395-B, which requests certain data from broadcasters concerning the racial and employment categories of employees. Collection of Form 395-B has been suspended since 2003, when the FCC stated its intention to conform the racial and employment categories on Form 395-B with those on the Equal Employment Opportunity Commission's (EEOC) Form EEO-1.
