Gordon Smith delivered his first public speech since last week's announcement revealed his new role as NAB president and CEO. The remarks were made during the 2009 NAB Radio Show Opening Address held at the Pennsylvania Convention Center in Philadelphia. "To call oneself a broadcaster, is truly answering to a higher calling. It's knowing you've been entrusted with the public's airwaves, and recognizing that what you report and air impacts the lives of your viewers. You serve your communities in remarkable ways, improving the quality of life and fostering the principles of localism. And it's going to be my job to make sure policymakers and the rest of America understand the many ways broadcasters give back to their communities," said Smith.

Opposition to RIAA Performance Tax Tops 250 in House, Reaches 25 in Senate
A bipartisan group of 251 House members and 25 U.S. Senators are now on record in opposition to a performance tax. The overwhelming Congressional opposition comes as the Recording Industry Association of America (RIAA) continues to lobby in support of legislation that would require local radio stations to pay an additional fee for every song aired free to listeners.

Satellite TV Bill Clears First Senate Hurdle
On September 24, the Senate Judiciary Committee passed a managers amendment to S. 1670, the "Satellite Television Modernization Act of 2009." The Senate Judiciary draft updates the law to reflect the digital television (DTV) transition and also proposes a number of structural changes to the local and distant signal licenses. Unlike the House Judiciary draft, the Senate draft does not contain language to allow DISH to regain its distant signal license upon certification that it is providing local-into-local service in all 210 markets.
