Sen. Ben Ray Lujรกn (NM) has introduced the Secure and Fair Enforcement (SAFE) Advertising Act in the Senate.

  • This legislation would clarify that local radio and television broadcasters may air cannabis advertisements in states where it is legal without the threat of administrative action from the FCC.
  • Similar legislation was recently passed in the House of Representatives.
  • NAB applauded the Senate bill's introduction for creating regulatory certainty for broadcasters.
  • We're keeping a close eye on this and will continue to work with policymakers throughout the process.

5. Changes to Foreign Sponsor ID Rule Expected to Take Effect Later this Summer

Hands on a laptop as documents project in the air

On July 12, a federal court vacated the requirement that radio and TV broadcasters search federal government databases for information on program sponsors to comply with the Foreign Sponsor ID rule. The court agreed with an NAB petition that the FCC lacked authority to adopt the requirement. The court's changes are expected to take effect later this summer.

  • The decision removes a significant burden on radio and television stations.
  • Stations will still be required to tell programmers about the rule, ask them about foreign sponsorship and disclose any foreign government-sponsored programming to the public.
  • The decision takes effect after the court issues its "mandate," which is expected in late August/early September (absent a rehearing request by the FCC).
  • ๐Ÿ“ NAB is releasing a revised compliance form on our Member Tools site prior to the effective date of the court's changes to the rules to allow stations to plan for future compliance. The original compliance form will remain on the site until the changes take effect.
