January 31, 2020 – All Stations: Commercial stations are required to file FCC Form 323 (Ownership Report for Commercial Broadcast Stations) and noncommercial stations must file FCC Form 323-E (Ownership Report for Noncommercial Broadcast Stations) by this date. All reports must be accurate as of October 1, 2019. In cases where a broadcast station is sold between October 1, 2019 and the filing date, a biennial ownership report must be filed by the party that owned the station as of October 1, 2019. January 31, 2020 – All Stations: Complete IRS Form 1099-MISC and send to recipients, and issue W-2 tax forms. This is the due date for filing Forms W-2 and W-3 with the Social Security Administration - whether you file using paper forms or electronically. Also, Form 1099-MISC is due to the IRS by January 31 when you're reporting non-employee compensation payments in box 7 of the form. Otherwise, file by February 28 if filing by paper, March 31 if filing electronically. Under the FCC's modernized carriage election rules, stations no longer send their elections via certified mail. Instead, a station must make its election by placing a carriage election statement (or multiple statements if they wish to make different elections regarding different MVPDs) in its online public file by no later than October 1, 2020. Failure to timely place an election statement in its online public file results in a default election of must carry with respect to cable operators, but a default of retransmission consent with respect to DBS providers, and will violate the public file requirements.
