NAB Tells High Court about Real-World Negative Effects of FCC’s Vague Indecency Policy

On November 10, NAB submitted to the Supreme Court a “friend of the court” brief supporting the New York federal appeals court’s earlier decision that the FCC’s current indecency policy violates the First Amendment.

NAB argued that the lower court correctly found that the FCC’s indecency policy is unconstitutionally vague, which has led to it being applied in an inconsistent and unpredictable manner. As a result, broadcast stations are never sure exactly what the law is in this area and that has resulted in a chilling effect on programming, especially live programming including news.
