FCC Seeks Comments on LPFM vs. FM Translators

The Federal Communications Commission (FCC) has issued a Notice of Proposed Rulemaking (Notice) seeking comment on how to implement the Local Community Radio Act of 2010, which opens the door for the licensing of more low-power FM (LPFM) stations. The Notice starts the FCC's development of rules for new LPFM stations, FM translator applications and how to resume the licensing of translator applications still pending from the 2003 FM translator application window. The FCC lays out several options for handling these pending translator applications, all of which turn on the relative presence of LPFM stations in various markets. The FCC also seeks comment on how it should implement the Act's mandate that licensing decisions between translators and LPFM stations should be based on an assessment of the needs of the relevant local community. Finally, the FCC proposes to expand the universe of translators available to AM stations by lifting the May 1, 2009, deadline by which translators must be licensed to be available to AM stations. The Notice is the first step in a proceeding that will greatly impact the ability of radio stations to use translators to enhance their service. Comments will be due 30 days after publication of the Notice in the Federal Register.
