On June 2, 2009, the FCC issued an order amending its previously ordered DTV post-transition procedures originally issued on March 13, 2009. The revised procedure allows stations the flexibility to commence authorized post-transition digital operations at any time on June 12, 2009, prior to 11:59:59 p.m. without prior FCC approval. The order no longer requires stations to file in advance with the FCC the specific time of day that post-transition digital operations will commence. However, in cases where stations commencing post-transition digital operation prior to 11:59:59 p.m. on June 12 could affect another station's operation on June 12, the FCC requires those stations to coordinate with other stations prior to June 12 to avoid any interference and ensure a successful transition for all stations; stations are not required to request prior approval from the FCC. If stations cannot coordinate a time for a successful earlier transition on June 12, then stations must wait until 11:59:59 p.m. to commence digital operations.
The March 13, 2009, order stated that the FCC will not consider termination of analog signals on June 12 prior to 11:59:59 p.m. as "early" or requiring FCC approval, which this order now extends to commencement of post-transition digital operations. The previous order required that stations inform the FCC and viewers the time of day analog termination will occur. Stations that now wish to change the previously filed time of day for analog termination to reduce the gap between analog termination and commencing post-transition digital operations should follow the procedure outlined in the Public Notice.
