NAB has filed both comments and reply comments pressing the Federal Communications Commission (FCC) to explore a new requirement that Sirius XM produce multifunctional satellite radios that can also receive HD Radio services. NAB argued that Sirius XM, as a monopoly satellite radio provider, can use its influence over satellite radio manufacturers to inhibit HD Radio. NAB also noted that Sirius XM substantially subsidizes the retail costs of producing and marketing satellite radios, and has revenue sharing arrangements with many automakers that create incentives for auto dealers to promote and install Sirius XM, at the expense of HD Radio devices. NAB also explained that the FCC possesses ample legal authority to impose this mandate on Sirius XM, who is subject to FCC jurisdiction as FCC spectrum licensees. Finally, NAB clarified that it is unnecessary for the FCC to adopt a reciprocal rule that would require HD Radio devices to include satellite radio technology.
